FUNCTION AND CONTENT
This series consists of lists which were compiled at the time that the first consignment in each series of High Court records were prepared for transfer.
The missing lists show the number and title of case records which appear in the relevant High Court registers but for which no documents could be found.
The imposed lists show the number and titles of cases where documents were found but which were not recorded in the register of the capital city of the State to which the documents belong. In all cases, the year in the annual single number series was considered to be the year in which the first of the documents was filed. If there was more than one bundle of documents in a year they were allocated the next available single number on a chronological basis using the full date of filing of the first document.
It seems that in the large majority of cases, if the matter did not proceed to a court hearing, it was not recorded in the register and the documents were not given a reference number.
In some instances, a case may have been transferred between States and documents have been found in both the States or documents may have been filed in one State in relation to a matter heard in another State and so where a number has been imposed on documents, there may be a case record in another State which documents the same matter.
Similarly where a file is missing, it may be that it is because the case was transferred to another registry and the documents may be found with that State registry's records. If a note was made to that effect in the register, the file was not considered missing and was not listed.
Attempts were made to cross-reference all such occurrences where sufficient information was provided.
This series has been compiled as a finding aid. As at March 1996, the registers have been retained in the custody of the High Court, Principal Registry (CA 624). |
