FUNCTION AND CONTENT

This series of case records documents appeals from the Supreme Court of Brisbane and from single Justices in the Full Court (rulings given or matters referred in respect of Cause and Court Book matters), and later, appeals from the Federal Court.  These matters were recorded in the Full Court Book (CRS A10041).

Also included are matters which were subsequently taken over by other courts.  Prior to 1921, the High Court had the jurisdiction now possessed by the Conciliation and Arbitration Commission.  Prior to the creation of the Federal Court, the High Court had jurisdiction in matters relating to Patents and Trade Marks and was the Court of Appeal from an assessment of the Commissioner of Taxation.  The foregoing matters together with applications for Prerogative Writs were recorded in the Court Book (CRS A10045).

System of Arrangement and Control

The records in the two book have been brought together because until 1917 only one sequence of numbers was used for them both.

Relationship with Other Records

CRS A10183 contains lists of case records which were missing at the time that the first consignment of a series was transferred.  A case record was not considered missing if the register clearly indicated that the matter had been transferred to another registry or that the documents were included with another case record.  In the latter case, items were cross-referenced if sufficient information was provided.

Custodial History

The High Court decided to centrally archive all of its records and these records were transferred from the Brisbane Registry to the Principal Registry at that time.
