The Commonwealth of Australia Constitution Act of 1900 gave the Commonwealth Government exclusive control of the collection of Customs and Excise duties and of the administration of associated laws and regulations. (1)  On 1 January 1901, the establishment of the Department of Trade and Customs was notified, under the administration of the Right Honourable Charles Cameron Kingston, PC. (2)

The Customs Act (No. 6 of 1901) was assented to on October 3, 1901, providing for a Comptroller-General of Customs, who was to be the permanent head of the Department and H N P  Wollaston, (3) the Secretary for Trade and Customs, Victoria, was appointed to the position which he held until 16 January 1911. (4)  The Excise Act (No. 9 of 1901) was assented to on October 5, 1901 (5) and it was from this and the Customs Act (6) that the Department derived its major powers.

The records in AA1963/44 refer to the Commonwealth Prices Branch.  The main functions of the Department included the collection of revenue for governmental purposes through Customs, Excise and primage duties and the administration of associated laws, regulations and procedure, the development and protection of Australian industry and the encouragement and regulation of Australian overseas trade. (7)

The Central Office of the Department of Trade and Customs was located in Melbourne from its establishment to 1927, when Federal Parliament and some Commonwealth Government Departments were transferred to Canberra. (8)

By 1906 the Department was responsible for administration of:          
 bounties;
 copyrights;
 Customs and Excise;
 designs and patents;
 lighthouses, lightships, beacons, buoys;
 quarantine;
 trade and commerce (including navigation and shipping);
 trade marks, dumping, monopolies and combines;
 weights and measures; and the
 censorship of literature and films.

It administered the following Acts:

In 1912 the Department was charged with the administration of fisheries and the Bureau of Agriculture (CA 222). In the same year the administration of copyrights, designs, patents and trade marks was transferred to the Attorney-General's Department (CA 5). In 1916 the Bureau of Agriculture and the administration of weights and measures were moved away from the department but in 1918 the department was granted additional functions relating to Board of Trade (CA 98), Institute of Science and Industry (CA 550), film censorship, price fixation and marketing of butter and wheat. Marketing of flax, fruit, meat, dairy products and sugar control came under the department's jurisdiction in 1923.

The Commonwealth Tariff Board (CA 103) was constituted in December 1921, under the Tariff Board Act and from its inception has been associated with the Department of Trade and Customs. (10)

By 18 November 1927 after the creation of the Department of Markets and Migration (CA 20), the Commerce Branch of the Department of Trade and Customs was transferred to the new Department. (11)

On the establishment of the Department of Markets and Transport (CA 23) in 1928, functions in relation to marketing were allotted to that department, as were, on paper only as it turned out, lighthouses, lightships, beacons, buoys, navigation and shipping. (12)  The Acts controlling these latter matters, namely the Navigation Act of 1912-1926 (13) and The Lighthouses Act of 1911-1919 (14), specified that they were to be administered by the Minister for Trade and Customs, requiring a change in the Acts Interpretation Act, so that notification in the Administrative Arrangement Orders would take precedence over the provisions of the Acts themselves. This was accomplished by Section 19A of the Acts Interpretation Act, 1901, which was assented to on August 14, 1930. (15)  By this date the Department of Markets and Transport had been abolished. The Acts; and the matters they controlled, therefore remained under the Department of Trade and Customs, until the Administrative Arrangements Order of 4 September 1930 placed them with the Department of Transport [I], (CA 26). (16)

During World War II, the Department became responsible for the administration of the following Regulations made under the National Security Act:

(a) National Security (Metal foil and paper) Regulations

(b) Control of Liquor Order issued under National Security
     (General) Regulations Reg 59 (16.3.1942)
(c) National Security (Malt) Regulations (SR 1943, No. 62)
(d) National Security (Tobacco Rationing) Regulations
     (SR 1942, No. 73)
     (SR 1943, No. 399)
(e) National Security (Wine Industry) Regulations
     (SR 1940, No. 54)
(f) National Security (Exchange Control) Regulations
     (part 11A) SR 1940, No. 282 as amended. (17)

By 1946 the Department also administered: (18)

The Department also gained responsibility for matters involved in Economic Warfare: seizure of enemy owned vessels, control of contraband, ship's stores, strategic war materials, trading with the enemy.
